2. Software License & Usage

Simply Chat Marketing grants you a limited, non-exclusive, non-transferable, and revocable license to utilize our software utilities in accordance with your purchased plan:

• Single-User Licenses: Restricted to installation and execution on a single computer or device. Sharing license keys is strictly prohibited.
• Multi-User / Enterprise Licenses: Limited to the specified seat count configured at purchase.
• Prohibitions: You may not modify, reverse-engineer, decompile, or copy the source code of our desktop tools or cloud script files.

3. Compliance & Acceptable Use

Simply Chat Marketing builds bulk communication and lead generation software. **You are solely responsible for ensuring your campaigns comply with global and local laws.**

• Anti-Spam Regulations: You must comply with all applicable telecommunications laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and local data privacy laws (GDPR, CCPA).
• Third-Party Policies: You agree to follow the terms of service of the third-party platforms you connect with. Simply Chat Marketing is not responsible for any telephone line restrictions, numbers blocks, or account bans incurred from violating WhatsApp's or Google's terms.
• Opt-In Consent: All marketing broadcasts should be directed strictly to clients who have actively opted-in to receive communications from your business.

4. Data Scraping & Platform Changes

Our data extractor tools (Google Maps, IndiaMART, JustDial, etc.) scrape publicly available listing information by interacting with target websites.

• Third-Party Dependency: We have no control over formatting, HTML layout, or security changes applied by target websites. If a third-party website changes its structure, we will update our scrapers as soon as possible, but we cannot guarantee uninterrupted data extraction.
• Rate Limits: You agree to utilize proxy configurations and delay adjustments to prevent overloading target websites. We are not responsible for any IP blocking resulting from aggressive scraping settings.

5. Subscriptions, Payments & Refund Policy

All billing is conducted through secure third-party billing nodes.

• Payment Fees: Licensing fees are collected upfront based on monthly, annual, or one-time lifetime tiers.
• Refund Exclusion: Due to the immediate delivery of digital license keys and downloadable tools, all sales are final once a license has been activated or software has been delivered. We encourage testing our trial versions before purchase.

6. Disclaimers of Warranty

All Simply Chat Marketing software tools, dashboards, and API services are provided "as is" and "as available." We make no warranties of any kind regarding suitability, uptime, or data accuracy.

7. Limitation of Liability

In no event shall Simply Chat Marketing, its developers, or its team members be liable for any direct, indirect, incidental, or consequential damages (including business loss, phone number suspension, API blocks, or data loss) arising from your utilization of our software tools.
